Client success story: Disability Discrimination
Posted on 12th December 2022
Our client applied for a role with a multinational bank, declaring at the initial interview stages that he was registered blind. He was offered the role, but the job was later withdrawn by the bank as they were unwilling to make the reasonable adjustments required for our client to undertake his role.
Our client had left his previous employment when offered this role. Having envisaged a long-term career at the bank, instead he was now out of work, and unsure of when he would find another suitable role. The rejection had affected his confidence. The bank was a multinational company with plenty of resources - if they were not willing to make adjustments for a suitable candidate, he was worried about finding a workplace that would.
Nazia initiated a claim against the bank, drafting the Claim Form on behalf of our client. Later, Nazia prepared the case for Tribunal proceedings, including drafting a statement of financial loss and working with our client to prepare his witness statement.
Our client hoped for a settlement that would reflect the emotional and financial impact of his treatment and avoid being left out of pocket while he found a new role. He also wanted the bank to be trained on Disability Diversity to ensure there was a level playing field for disabled applicants in future.
While preparing the case for tribunal, Nazia continued to attempt to reach a settlement with the other side that reflected our clients wishes. Having seen the strength of the case we presented, the other side was willing to negotiate a settlement. We manage to reach an agreement that included all of our client’s priorities and provided financial relief.
Our client was happy with the outcome. He has since secured a job with a supportive organisation willing to make adjustments to support him in the role.
