Client success story: Making redundancies

Our client was a vehicle transportation company facing the need to make redundancies. They wanted to ensure that the process was legally compliant and to minimise upset to staff as far as possible in the circumstances, whilst causing as little disruption as possible to the day-to-day activities of the business.
The company instructed us to advise on the consultation process and review their redundancy policy, criteria and scoring, and pool of candidates.
Andrea spent time understanding the business and the changes proposed before advising our client on the legislation applicable and the principles to be applied. She then reviewed relevant documentation and suggested changes to ensure they were legally compliant. It was also important the documents were drafted clearly, so that all staff were clear on the process and how it could impact their future with the business.
Andrea considered the pool of potential affected employees provided by the client to make sure that all employees at risk were included (an incorrect pool often leads to legal claims), that the selection criteria were fair (frequently another cause of litigation) and that selection criteria scoring was appropriate. She then supported the client through the redundancy process, including consultation with affected employees, which resulted in the redundancy of several staff. Andrea ensured the correct redundancy calculations and notice periods were applied to those who may be made redundant.
Our advice and guidance helped the client to do this with little hassle and disruption to the business and maintained ‘business as usual’. The client is still operating and received no disputes relating to the redundancy process. They continue to instruct us when in need of employment law advice.
